By accessing this service and any of its pages, you are agreeing to these specific GamerHeaven Terms of Service below and our general Terms & Conditions that govern the access, use, interaction, viewing, downloading, payments, and any other action by all users of the Content offered by an 8elements or otherwise branded or managed Service, Product, Application, Website, Site, etc that you have accessed ("Service").

AGREEMENT

Thank you for being a member of and subscribing to the GamerHeaven Games Club (in the following referred to as the SERVICE) for STC, Mobily, and Zain users in the Kingdom of Saudi Arabia.
You agree to be bound by these membership Terms & Conditions (“Terms of Service”) between you and 8 Elements Ltd or any of 8elements affiliates or related companies or business partners which specifically govern the contractual relationship for GamerHeaven and its subscribers and set the way in which our product, service or content may be used, in a legally binding way.
You accept our general Terms & Conditions.

1. SERVICE

The SERVICE is a daily based on installment service which is activated when you confirm the subscription on the SERVICE mobile site, via SMS, via mobile advertisements, via your selected payment provider, or any other possible way. The subscription to the SERVICE allows you to download four games from this mobile site every week according to 8elements catalogue for only SAR 1 (exclude vat) per day (WEB/WAP/DATA connection charges are not included).
Your annual subscription to the SERVICE is a daily membership installment payment which recurs if you have not unsubscribed. You can unsubscribe from the SERVICE at any time (please note the minimum subscription period of 2 weeks) by clicking on STOP subscription or EXIT or CANCEL in the designated “My Account” section. Once you have unsubscribed, you will lose all credits on the SERVICE and will not be able to download any games using your credits. 8elements reserves the right to end your subscription at will.

2. ELIGIBILITY

This service is available to STC, Mobily, and Zain subscribers in the Kingdom of Saudi Arabia only.

3. ACCESS TO THE SERVICE

In order to gain access to the SERVICE, you will first need to click on Join Now or Confirm on any banner, mobile advertising, landing page, any website advertising the SERVICE, or the mobile site itself. You can also subscribe by responding to USSD menu messages or sending SMS confirmations from your own mobile phone. You will then be charged SAR 1 (excluding VAT) for that day.
Following that, you can access the SERVICE to choose and download your first free game of the week. Every day, you will be charged SAR 1 (excluding VAT) and be given credits to download your games. You will be a member of the SERVICE until you unsubscribe.

4. PAYMENTS

You, the subscriber, will be charged SAR 1 each day on your phone bill. If you are a prepaid user, please ensure that you have enough credits on your prepaid card before you subscribe to the SERVICE.
In case you do not pay your daily membership fees, you will not receive new game credits. However, your existing accumulated credits are still valid and you can exchange them for fun new games to play

5. PERSONAL INFORMATION

You have the right to gain access, amend, and/or oppose the communication of data by 8elements on yourself regarding the SERVICE and your membership on request by writing to 8 Elements Ltd at Unit 901, 9/F. New Mandarin Plaza Tower B, 14 Science Museum Road, Tsimshatsui East, Kowloon, Hong Kong SAR.

6. MODIFICATIONS

8elements reserves the right to change these Terms of Service at any time at its discretion.

7. GOVERNING LAW

These Terms of Service are governed by and construed in accordance with the laws of Malaysia. You, as a subscriber, irrevocably consent to the exclusive jurisdiction of the Malaysian courts notwithstanding the jurisdiction where you are based.

8. ADDITIONAL MEMBER BENEFITS

Please note that all additional member benefits, if there are any on offer on the Site, are for a limited period of 3 months only. Members will have to show the member benefits WEB page or My Account page for any discounts or promotions to be applicable at any retail partner promotion whether online or offline. Additional Terms & Conditions are available at the respective partner sites.
For all contests, competitions, quizzes, leaderboards, and promotions, please check online at respective special pages and/or partner sites for detailed Terms & Conditions. Any draws or judges’ decisions are final and no correspondence will be entertained.
Please note that any prize, award, credit, or refund which is not claimed within 1 month will be forfeited.

9. SPECIFIC TERMS FOR THIS SERVICE

During the period when you are a member of the SERVICE, you will get to choose four games per week. You may accumulate your weekly credits for an unlimited time.
Please note that the minimum subscription period is 2 weeks.
If you unsubscribe within the first 2 weeks of your subscription and you are enjoying a First Week Free or Trial or otherwise free offer, you will be blacklisted for a period of 4 weeks and after 4 weeks, you will then be allowed to subscribe again to the SERVICE.
In case you stay inactive and do not visit the SERVICE site for a consecutive period of 24 months (twenty-four) we will unsubscribe you automatically and you will be notified by service SMS.

You confirm that accessing the service based on these Terms of Service fees applies for recognition and acceptance confirmation.
